1. Write a 3-5 paragraph answer to the prompt below:

Congratulations, you have been elected to the U.S. House of Representatives. It’s time for you to get a bill passed. Your bill will be a simple one that seeks to allow something, purchase something,  or make something illegal (ex: texting while driving, lowering the drinking age to 18 for military personnel, raising the drinking age to 25, revocation of income taxes, etc).  What you should do for this assignment is write a 2 page or 5 paragraph )description of how your bill will be proposed and passed. Make sure you describe how the bill goes from being proposed on the house floor, through the house, then to the Senate ending with the bill making it to the President’s desk. Also make sure you describe what goes on in each of the committee as well as one the floor. An ample description of this process can be found in the textbook, lecture, and online.  Use the legislative process diagram in your lecture and the examine the resources at the Center for Congress at Indiana University (http://congress.indiana.edu/index.php).

3. Watch the Documentary: Obama’s Deal online at http://www.pbs.org/wgbh/pages/frontline/obamasdeal/view/ & answer the following questions. 1 paragraph each for A-E

(a). Briefly describe the deals that were made by the Obama administration to get the Healthcare Reform Act of  2009 passed.

(b)  Briefly articulate (bullet points are fine) the main aspects of the Healthcare Reform Act of 2009 (aka Obama-Care). Make sure to list the sources you use (don’t just pull from memory).

(c). Do you think it is appropriate for lawmakers to log-roll and make deals in order to get bills passed?

(d). Would you bias change if it were an issue that was really important to you (like gun rights, drug law liberalization, prayer in schools, civil rights, etc.)?

(e). If you were the Democrat’s Party Whip in the House of Representatives in 2009, articulate what types of  techniques (use some of the techniques in your lecture) you would use to ensure that enough Democrats voted for the Healthcare Reform Act? Would Republicans use any different techniques to keep their fellow Republicans from voting for the measure?

 

4. Choose one of the following topics and write whether or not you feel it is a reasonable exercise of government authority & restriction. Prohibition of marijuana or other drugs, prohibition of assisted suicide, or prohibition of prostitution. After selecting a topic, write why you do/don’t support these types of laws, what arguments would someone who opposes your stance argue, and ultimately, to you what should be the limit of government prohibitions and restrictions. (2 pages)

5. Congratulations, you have just been nominated and confirmed to be a justice on the U.S. Supreme Court. Please briefly articulate how you think the U.S. Constitution should be interpreted by judges. Are you restraintist or activist? If restraintist, how would you decide on issues like privacy, civil rights, and the rights of criminals? If you are an activist, how would you determine how far you can stretch your interpretation of the wording of the Constitution? (2 paragraphs)

 

6. Explain how a case makes its way through the judicial system. Make sure to explain the difference between courts of Original Jurisdiction and those with Appellate Jurisdiction as well as the different types of courts, (District Courts, U.S. Supreme Court, State Supreme Courts, State and National Appellate Courts, and Petit Courts).  What are some distinguishing characteristics of the Texas Judiciary? 7. What is the difference between a Probate Case, Contract Suit and a Tort Suit? Describe the differences between economic damages, non-economic damages, & punitive damages in a civil suit?

 

 

8. In 1995, OJ Simpson was accused of murdering his wife (Nicole Brown Simpson). A jury acquitted Simpson because they did not feel there was enough evidence to meet or exceed the standard of beyond a reasonable doubt. However, Nicole Brown Simpson’s parents sued OJ Simpson in a civil tort case claiming “wrongful death” of their daughter. A jury awarded the Brown family millions of dollars in damages. Focusing on the requirements for conviction/culpability, explain how it is possible that OJ Simpson was acquitted of murder in a criminal trial yet could be found culpable in a civil trial for the same act?
