Week 4 Discussion 1

Homicide

Define the crimes of voluntary manslaughter, involuntary manslaughter, and negligent homicide. Provide examples for each type of homicide. Evaluate whether the felony murder rule would apply to any (or all) of the three crimes?

Your initial post should be at least 250 words in length. Support your claims with examples from the required material(s) and/or other scholarly resources, and properly cite any references. Respond to at least two of your classmates’ posts by Day 7. Focus on how mens rea affects the type and degree of homicide and how it shapes the charge that can be proven in court.

Week 4 Discussion 2

Robbery and Extortion

Which crime, robbery or extortion, is more harmful to the victim of the crime? Discuss the similarities and the differences between these two crimes. Your primary response should examine the potential culpability of the victim for either crime. Does the fact that the victim may have done something wrong affect your viewpoint of the heinousness of either crime?

Your initial post should be at least 250 words in length. Support your claims with examples from the required material(s) and/or other scholarly resources, and properly cite any references. Respond to at least two of your classmates’ posts by Day 7. Robbery and extortion contain similar elements as far as how the victim is harmed; however, both crimes follow very different routes to their commission. Should one crime be punished more severely than another? Your response to this question will challenge your views on how we measure the appropriate punishment for crimes. If the victim “causes” the ability for the crime of extortion, should people be punished less than the person committing the average robbery?


Week 4 Assignment

Sexual Predator Prosecution

Prepare a paper that details your home state's approach to sexual predators. Address following items in your paper:

  1. Does your state have any laws that prohibit conduct that would be considered to be predatory?
  2. What types of crimes are codified into law, misdemeanor, or felony?
  3. What are the punishments?
  4. Are there mandatory punishments, or do judges have discretion in sentencing a defendant after conviction?
  5. According to the statutes that you research, is mere solicitation of improper activities enough for a prosecution, or must there be physical contact?
  6. Provide your opinion on the statute(s) and their varying severity on sexual predators.

 
NOTE: If you cannot locate your state's statutes, please research Florida's.

The paper must be three to four pages in length and formatted according to APA style. You must use at least two scholarly sources in addition to the textbook to support your claims. Cite your sources within the text of your paper and on the reference page. Week 5 Discussion 1

Double Jeopardy

Which amendment to the Constitution prohibits double jeopardy? Can someone be convicted for multiple crimes for one act? How can a person be charged with multiple crimes through the legal concept of “lesser included offenses”? How do lesser included offenses not violate double jeopardy protection? Focus upon the material elements of crimes and how they can vary to allow for multiple prosecutions for the same acts or similar offenses. Provide examples to support your answer.

Your initial post should be at least 250 words in length. Support your claims with examples from the required material(s) and/or other scholarly resources, and properly cite any references. Respond to at least two of your classmates’ posts by Day 7. Fairness should be considered in any criminal law or procedure issue. Provide analyses of your classmates’ postings with an emphasis on whether or not it seems fair to the defendant to have to defend against crimes presented in multiple forums. Can we assume that it is fair to the State to prosecute in multiple jurisdictions (where the State has large amounts of resources for such actions)?

Week 5 Discussion 2

Mandatory Sentencing

The trend in the United States is toward mandatory sentencing for most criminal offenses. Include the following in your initial post:

  1. Define mandatory sentencing.
  2. Discuss the pros and cons of mandatory sentencing.
  3. Provide your opinion of whether or not you agree with mandatory sentencing provisions.
  4. Examine whether or not courts should view each case based on its own facts, or whether or not equal justice can only be achieved through mandatory minimum sentencing.

 Your initial post should be at least 250 words in length. Support your claims with examples from the required material(s) and/or other scholarly resources, and properly cite any references. Respond to at least two of your classmates’ posts by Day 7. Focus upon the fairness of treating everyone the same, regardless of the circumstances which brought them to the sentencing before a court. Question the validity of a “one size fits all” criminal justice sentencing scheme.

Week 5 Final Paper

Prepare a paper that details the entire criminal justice process for a felony criminal charge filed in a state court. Your paper will:

  1. Summarize all of the steps between arrest, pre-trial, trial, and appeals (both state and federal appeal possibilities).
  2. Address contingencies for each stage of the proceedings and examine all possible outcomes.
  3. Outline the chronological timeline of the criminal justice process.
  4. Analyze how constitutional protections for the defendant work at each stage of the proceeding.
  5. Evaluate whether the system effectively deals with criminal prosecutions, or whether changes or improvements are required.
  6. Create suggestions to make the system more fair and ethical for all those involved.


The paper must be eight to ten pages in length and formatted according to APA style. You must use at least five scholarly sources (at least two of which can be found in the Ashford Online Library) other than the textbook to support your claims. Cite your sources within the text of your paper and on the reference page. Writing the Final Paper
The Final Paper:

Must be eight to ten double-spaced pages in length, and formatted according to APA style as outlined in the Ashford Writing Center.

  1. Must include a title page with the following:
    1. Title of paper
    2. Student’s name
    3. Course name and number
    4. Instructor’s name
    5. Date submitted
  2. Must begin with an introductory paragraph that has a succinct thesis statement.
  3. Must address the topic of the paper with critical thought.
  4. Must end with a conclusion that reaffirms your thesis.
  5. Must use at least five scholarly resources, including a minimum of two from the Ashford University Library.
  6. Must document all sources in APA style, as outlined in the Ashford Writing Center.
  7. Must include a separate reference page, formatted according to APA style as outlined in the Ashford Writing Center.
