Project #15090 - Need Help with these four questions!!!!!

 I need these 4 questions, completed for my political science/ law class

1.      1)  Discuss in detail the contributions of Woodrow Wilson and Oliver Wendell Holmes, Jr. to the argument for “living constitualism.  In what way, if any, is Justice Stephen Breyer’s “purposivism” similar to “living constitutionalism?”

 

2.      2) Discuss in detail the case of Marbury  v. Madison and C.J. John Marshall’s defense of judicial review.  How do Marshall, Justice Gibson (in Eakin v. Raub) and Thomas Jefferson differ as to where authority resides in matters of determining the meaning of the constitutional text?

 

3.      3)  In light of relevant case law, discuss the judicial doctrines of “standing to sue” and “political questions.” Why might it be argued that each of these doctrines are means by which the courts attempt to exercise judicial self-restraint?

 

4.   4)    Discuss in detail the case of McCulloch v. Maryland and C.J. John Marshall’s arguments regarding the meaning of the “necessary and proper” clause of Article I  Section 8.  To what extent might Marshall’s argument depend on Blackstone’s approach to textual interpretation?
