Project #30064 - HRM-Legal Environment of Employment Decisions

The scenario below should be used to complete your course paper.  Company ABC must conduct a layoff due to economic difficulties.  Twenty-five of ABC's one hundred (25%) employees must be let go.  Because workers who have been employed longer generally make more money and have a greater benefit cost, management has suggested using an inverse seniority policy to determine who gets laid off.  Under the policy, the twenty-five people who have been employed the longest will be laid off.  A severance package will be offered to those being let go.  Because men generally are the heads of households and support dependents, ABC is going to offer them more severance pay than women.  Some employees are union members and their CBA provides less severance than the Company plans to offer, so management is going to be nice and give them the higher severance amount.  At the termination meeting, the HR representative will ask employees to sign a release of all potential claims before leaving the building.  If they don't sign the release that day they cannot get any severance pay.  Also, HR will instruct the employees that their benefits will end at the end of the month. Discuss the laws applicable to this scenario and any problems you see with the way ABC plans to proceed.
