I have submitted this assignment previously and REALLY need HELP!!! This is NOT an essay, but providing information and forming a couple legal documents. This is a 4 part assignment. PLEASE ONLY BID IF YOU HAVE LAW EXPERIENCE.

Based on Attached Scenario;

 

1.Determine what charges Hilton should be charged with based upon her actions. Explain why you believe these charges are appropriate. Then, based upon the statutes that you decide she should be charged with and the sample documents provided, prepare the complaint, the information and the indictment as if you were the prosecutor for the Landview State’s Attorney’s Office, 12th Circuit Court, Landview County, South Park, South Dakota. 

 

2.After preparing the documents for the prosecution, assume the role of legal assistant for Hilton’s attorney, Denny Crane of Crane, Poole and Schmidt. Mr. Crane has asked you to determine if the officer had reasonable suspicion for the stop and probable cause for the arrest for a motion to suppress that he intends to file on her behalf. Log on to http://www.sdjudicial.com. Loocate and read the South Dakota Supreme Court’s opinion in, State v. Noteboom, 2008 SD 114, filed Tuesday, November 28, 2008. Prepare a case brief comparing the facts of the two cases, the issue decided in Noteboom, the rule created by the court and give a legal opinion as to whether Mr. Crane is likely to win a motion to suppress the stop based upon the law.

 

3.Mr. Crane also requests that you review the report and complaint and determine what possible defenses Hilton will have with regard to any of the charges along with an analysis of how successful these defenses may be. 

 

4.Finally, Mr. Crane would like to be able to advise Hilton of the possible consequences if she is convicted of any or all of the crimes she is charged with. Please prepare an outline of what the maximum and minimum (if any) penalties are for each charge as well as what other conditions could be imposed by the Court if convicted.

 

In completion should include; The prosecution, motion to suppress, defense and sentencing.
