You have read articles pertaining to fraudulent work committed by Fred Zain and Joyce Gilchrist. Why do you think they were able to continue their work for such a long period of time? How do you think fraudulent work could be avoided? How should these employees be dealt with (retrained, fired, demoted, et cetera)? Please explain and please keep budgets in mind.
In addition, do you think that requiring all criminalistics to become certified in their area of expertise would prevent scientists like Zain and Gilchrist from performing fraudulent work? Similar to physicians or lawyers, who are required to take a board examination prior to practicing in their occupation, should criminalists have the same requirement to become certified?
nalyze the following---At 11:05pm, Justin and his friend Selena are sitting in a car in a parking lot adjacent to a strip mall where The No.1 Chinese Food take-out restaurant is located. The restaurant closes at 11:00pm and every night towards the end of his shift, Police Officer J. Hoover drives through the parking on routine patrol. This particular evening, Officer Hoover’s shift ended at 10:30pm, but his patrol of the lot was delayed due to a particularly difficult traffic stop that he was involved with earlier in the evening.
Upon entering the lot, the officer detects the distinct aroma of burnt marijuana in the air. He then sees Justin's car--parked, no lights, and occupied by two people. Officer Hoover decides to investigate further. As he walks up to the car, he sees what appears to be a large bag of marijuana laying on the ground, outside the passenger side of the car, approximately 4 to 5 feet from where Selena is sitting inside the car. He also notices that the windows on both sides of the vehicle are down. However, as he approaches Justin’s 2015 Lamborghini Huracan, Hoover no longer smells marijuana nor does he see any other indication of criminal activity. He does notice that Justin has a large tattoo of a marijuana leaf on his left arm. Justin is cooperative and tells the officer that he and his girlfriend have had a long day at work and are simply waiting for the restaurant to fill their take-out order.
It should be noted that the parking lot services a strip mall that contains several businesses—all of which are closed at this point in the evening. Several signs are posted in the lot indicating that the lot is only for patrons of the mall and may not be used after hours.
Without referencing our textbook or any other course materials, and simply based on your general knowledge of the American criminal justice system, may Officer Hoover 1) ask Justin and Selena to get out of the car, 2) search the car, and 3) place Justin and Selena under arrest (if so, for what crime)? Would your answer change if you knew that Justin has approximately 2 lbs. of marijuana in the trunk and a gun under the driver’s seat of the Lamborghini?
