Daubert v. Merrell Dow Pharmaceuticals and Frye v. United States are the two main rulings in the United States governing the admission of scientific evidence in courtrooms. As I do not want to receive multiple explanations of the rulings in Maryland, please check the list below for “your” state.  Research “your” state to determine which ruling governs scientific evidence in that state. You also should perform research to determine if there are also any state rulings that are used in conjunction with either Daubert or Frye. After determining which ruling is used in your state, discuss how new scientific evidence would be presented in court for the first time in your state.  To discuss how a new scientific technique would be introduced, you can discuss how that has happened in the past or you can make up a new scientific technique and discuss how that would be introduced into your state courts. 

 

 

Why do you think there is a 70-year time span between Frye and Daubert?  What were the “weaknesses” evident in the 1923 Frye case?  What were the “advantages” introduced by the Daubert standard?

 

 

 

 

Last week, we covered Business Processes, including Process Improvement through streamlining and reengineering, and process modeling of both the As-Is and the To-Be processes.   

Drawing from your own experience, select a process (a set of specified steps to accomplish a task) used at your place of work or in your interaction with a business that you would like to see improved.  Explain why you picked that process.  Explain how you would go about improving it.  Who should be involved with you?  What are some of the questions you should ask about the current process?  How will you know if the process was actually improved?

First, we need to be sure you can identify a process; many students have difficulty with that, so refer to your textbook readings.  I am also interested in the method to be used to improve the process, not a solution.  (For example, I am not looking for something like:  "The Café where I work is not selling enough coffee. We should use social media to advertise more."  The discussion here is about identifying a process and how the Café would go about deciding how to improve that process, who should be involved, what should be considered, and what steps should be taken.)  You should employ the techniques discussed in class or those that you find in your research.
