A hotel, which is 300 metres from the beach at Surfer's Paradise, advertises throughout Australia that it is 'only a stone's throw away from the beach'. Has it committed a breach of s18 of the ACL. Has it committed a criminal offences under the ACL?

A battery manufacturer claimed in an advertisement that its batteries 'lasted up to ten times longer than ordinary carbon batteries'. It is established that such a claim could be justified in exceptional situation, but that for common uses, for example in torches and transistor radios, the batteries only lasted two to three times longer than competitive carbon batteries. Has the battery manufacturer breached any laws?
