The Equality Act brings together a number of existing laws into one place so that it is easier for people to use. It sets out a persons characteristics that are protected by the law and behavior that is unlawful. Simplifying the legislation and to bring protection in line for all of the characteristics covered will help Britain become a fairer society, improve the public services, and help business to perform well. The Equality Act also strengthens the current legislations to provide Britain with a new anti-discrimination law which protects individuals from unfair treatment and encourages a fair and more equal society for everybody.

  Under the Equality Act, people are not allowed to discriminate (Discrimination means treating one person worse than another because of a protected characteristic (known as direct discrimination) or putting in place a rule or policy or way of doing things that has a worse impact on someone with a protected characteristic than someone without one, when this cannot be objectively justified which is known as indirect discrimination), harass (Harassment includes unwanted conduct related to a protected characteristic which has the purpose or effect or violating someone’s dignity or which creates a hostile, degrading, humiliating or offensive environment for someone with a protected characteristic) or victimize (Victimisation is treating someone unfavourably because they have taken (or might be taking) action under the Equality Act or supporting somebody who is doing so) another person because they have any of the protected characteristics. Along side this there is also protection against discrimination where someone is thought to have one of the protected characteristics or where they are associated with someone who has a protected characteristic as the same law applies to them.

  Every person in Britain is protected by the Act. The ‘Protected Characteristics are; Age, Disability, Gender Reassignment, Marriage and civil partnership, Pregnancy and maternity, Race, Religion and belief and Sexual orientation.


  There is a broad policy imperative to understand the impact of the legislation and whether the Equality Act is meeting its stated objectives and original intentions, and where it is not. The evidence generated through the Evaluation Framework is focused on indicating where the Equality Act 2010 has met its two main objectives: To Simplify the legislation, by removing anomalies and inconsistencies that had developed over time in the existing legislation (thus making it easier for people to know their rights and responsibilities, and avoid unknowing failure to comply) and to Strengthen the legislation by extending the protection from discrimination in certain areas (which are providing greater and more consistent protection for the various equality “strands”) and a number of specific new measures.
