Mineral rights
We have all heard in the news the brew haha over mineral rights and oil leases, etc.  So what is the big deal?  If you owned land you would assume that you also owned the subsurface, under your land, including any mineral wealth that may be there. Correct? Well, you may be wrong. The Constitution states that we can own property. But some state constitutions provide that all mineral rights belong to the states.

Your assignment is to look at your State’s constitution to determine if you own the mineral rights to your property or not (if you do not live in a US State, pick any State) and answer the following questions:

use the state of virginia 


How do you feel about this?
Do you think it is fair?
Do you think the State or the Federal Government should own all mineral rights? With or without compensation?
Who do you think should own mineral rights? The surface owner (that would be you if you have land) or the State?
